Specializes in corporate disputes concerning M&A transactions and commercial contracts, as well as disputes regarding bankruptcy and infrastructure investments, in particular those implemented on the basis of FIDIC standard contract terms;
Represents businesses in various industries and sectors, as well as local government entities in proceedings against the State Treasury, in proceedings before domestic courts, arbitration tribunals and the Polish Supreme Court;
Also advises on matters related to the conclusion, performance and settlement of infrastructure and PPP agreements, as well as advising creditors and bankrupt debtors on bankruptcy and restructuring law.
Selected experiences
Has advised, among others:
- municipal companies in disputes with contractors of public utility facilities and in negotiations with the National Fund for Environmental Protection and Water Management (NFOŚ), including in court and arbitration proceedings related to the suspension of co-financing payments;
- a public company and its shareholders in a number of proceedings related to an allegation of collusion;
- on disputes between the awarding entity, financing bank, and a consortium of contractors including a bankrupt debtor regarding the settlement of payments for construction works;
- on disputes concerning a public operator’s termination of long-term agreements in the renewable energy sector;
- foreign companies in proceedings on the settlement of cross-border transactions;
- on disputes regarding legal defects in an enterprise being sold;
- local government entities in disputes with the State Treasury on the withholding of targeted subsidies and a reduction in the amount of general subsidies;
- a bankrupt’s shareholders in restructuring proceedings and in contentious court cases related the these proceedings, as well as creditors in bankruptcy proceedings.
