WKB Wierciński, Kwieciński, Baehr law firm advised EW Rywałd sp. z o.o., being a part of leading independent investment and asset manager KGAL, at the stage of contractor selection for the Wind Farm Rywałd project in Poland. Our support consisted in the preparation of a “tailored fit” contract draft to meet the client’s individual needs, participation in the negotiation process, including assessment of changes to the Balance of Plant contract put forward by the bidders, negotiations with the preferred bidder, changes to the BoP contract, and supervision of the signing process with the preferred bidder.

The project was awarded to a consortium of two leading contractors, i.e. ONDE S.A. and P&Q sp. z o.o. The Rywałd Wind Farm will be located in Radzyń Chełmiński commune, around 70 km north-east of Toruń, and will have installed capacity of 27 MW generated by 9 Nordex turbines. The turbine supplier contract has already been concluded and the commencement of the construction is scheduled for the beginning of 2022, with taking-over of the works in spring 2023.

WKB’s team was led by Marta Midloch (partner), who was supported by Agata Kukawka-Evers (senior associate) with respect to infrastructure matters, Marek Prętki (managing associate) with respect to insurance matters, and Maciej Szambelańczyk (partner) in regard to energy matters.

WKB was once again selected by KGAL. We have also advised Baltic Green I, a company managed by KGAL, at the stage of contractor selection for the Wind Farm Kąty (Krasin) project.
